1. This GoPayz Rewards Programme (“Programme”) is made available by U Mobile Services Sdn Bhd, Registration No. 2004010134375 (672884-H) (“U Mobile”) which will commence on 25 October 2019 until withdrawn by U Mobile (“Programme Period”).
a. This Programme is open to all GoPayz subscribers.
b. U Mobile reserves the right to reject any participant without assigning any reason.
4. GoPointz
(a) You will be entitled to receive GoPayz rewards points (“GoPointz”) for selected successful transactions you or your supplementary card holder perform via your GoPayz account using your GoPayz MasterCard, Visa or UnionPay card, FPX or your debit or credit card tied to your GoPayz account (“Transaction”).For clarity:
- GoPointz accumulation will begin from zero;
- GoPointz will not be awarded if you perform any transaction via your GoPayz account via redemption of existing GoPointz. By way of an example, if you use your existing GoPointz to redeem any mobile reload, game code or to pay for any purchase made via GoPayz, you will not receive any GoPointz for the said transaction; and
- a Transaction is deemed to be successful if Transaction is not cancelled or a refund is not provided for the Transaction in accordance with the respective merchant or service providers’ policies.
(b) GoPointz will be awarded to you based on the price chargeable for each product or service purchased via the Transactions (excluding taxes, shipping costs and other ancillary charges) (“Product Price”). The amount of GoPointz provided for each Transaction is made available at the FAQ section on GoPayz mobile application (“GoPayz App”) or GoPayz website (“GoPayz Web”).
(c) U Mobile may at its discretion revise from time to time how we award GoPointz. The GoPointz awarded are final.
(d) For any cross-border Transactions, any GoPointz awarded will be converted into the local denomination at a rate determined by U Mobile.
(e) You can view the GoPointz collected via GoPayz App and GoPayz Web.
(f) Each GoPointz collected shall be valid for a period of 24 months from the date they are credited into your account (“GoPointz Validity Period”). U Mobile may revise the GoPointz Validity Period from time to time at its sole discretion, without notice.
(g) GoPointz earned are personal to the GoPayz account holder, not transferable and cannot be exchanged or redeemed for cash.
(h) You must fulfill all the requirements specified for GoPointz award prior to performance of any Transaction. If you fail to fulfill the requirements specified, we will not entertain any request to award the GoPointz to you for the Transaction performed.
(i) U Mobile reserves the right at its sole discretion to disqualify, decline or reject any transaction by you at any time without notice if U Mobile believes that you have undertaken fraudulent practice(s) or GoPointz is:
- recorded in error;
- related to a Transaction which has been cancelled or where a refund has been given; or
- undertaken any activities (including but not limited to fraudulent activities) harmful to the Programme; or
- for any other reasons U Mobile deems fit.
a. You may use the GoPointz to redeem various rewards from participating merchants’ outlets or at such places or on such items as U Mobile may specify from time to time (“Rewards”).
b. You may receive instant surprise reward after performing selected Transactions as determined by U Mobile (“Surprise Rewards”).
c. The Rewards and Surprise Rewards shall be collectively referred to as “GoPayz Rewards”.
d. You are not allowed to redeem GoPayz Rewards using the GoPointz where the GoPointz Validity Period of such GoPointz has expired.
e. GoPayz Rewards are provided on an “As Is” basis. U Mobile makes no representation nor warranty of any kind with regards to the GoPayz Rewards including fitness for purpose or merchantability.
f. All GoPayz Rewards provided by a third party supplier are subject to the terms and conditions imposed by that supplier. U Mobile may (but is not obliged to) act as an intermediary between you and the third party. However, U Mobile shall not be responsible for any failure or delay of the third party supplier to supply to GoPayz Rewards, or loss or damage of such GoPayz Rewards during delivery.
g. You must ensure that your GoPayz account is active at the point of redemption. For clarity, active means you are able to perform Transactions via your GoPayz account.
h. GoPayz Rewards can only be redeemed by GoPayz account holder and not GoPayz supplementary card holders.
i. You are required to provide a valid 6-digit PIN for each redemption request. U Mobile will reject any redemption request with invalid PIN.
j. Once you submit a request to redeem GoPayz Rewards, you are not allowed to cancel, exchange or return the request.
k. You may redeem all or part of your GoPointz subject to U Mobile’s redemption procedure as applicable from time to time.
l. The number of GoPointz required for any purchase or redemption of GoPayz Rewards may be revised by U Mobile at its sole discretion from time to time. U Mobile may impose additional conditions in using the GoPointz for purchase or redemption from time to time at its sole and absolute discretion.
m. GoPayz Rewards may be redeemed using GoPointz or a combination of GoPointz plus cash, card or vouchers.
n. Upon successful redemption of the GoPayz Rewards, U Mobile shall deduct your GoPointz used for the redemption or if applicable, additional GoPointz equivalent to the value of the GoPayz Rewards will be added to your GoPayz account. Any deduction of GoPointz can only be used to deduct the Product Price in pre-determined blocks as determined by U Mobile. GoPointz is not available to deduct any other fees and taxes including but not limited to Sales and Services Tax, which must be paid for separately. The GoPointz value may be revised by U Mobile from time to time.
o. U Mobile may refuse any redemption request if U Mobile has any reason to suspect that the GoPointz were fraudulently accumulated or wrongly recorded.
a. U Mobile may change any of these Terms and Conditions and may terminate or suspend this Programme or extend the Programme Period. Any such change will be announced on our website. It is your responsibility to check these Terms and Conditions on our website and if you do not agree to any of the changes, you must immediately cease participation in the Programme.
b. The GoPointz Rewards are accepted entirely at the risk of the participants. To the extent permitted by law, U Mobile excludes all liability in connection with this Programme. All participants agree to release U Mobile and its affiliates from and indemnify U Mobile and its affiliates against all liability (including negligence) for any personal injury or for loss or damage (including loss of profits, revenue or opportunity); whether direct or indirect, special or consequential arising out of participation in this Programme.
c. By participating in the Programme, all participants: -
- consent for U Mobile to collect, record, hold, store, use and disclose their personal information for purposes which are necessary or related to the participation in the Programme;
- consent for U Mobile to disclose or publish their personal information such as their names and identities and any general information that U Mobile sees fit about the participants in any media, marketing or advertising materials; and
- grant U Mobile the absolute and unrestricted right to modify, use and publish any still or moving images of the participants for any promotional, marketing, commercial or other related purpose, without any payment or compensation.
d. Any and all decision made by U Mobile in relation to every aspect of the Programme, shall be final and binding. Any subsequent correspondences, protest, appeals or enquiries will not be entertained.
e. The subscription and use of GoPayz are subject to the GoPayz Service Agreement and where applicable, these Terms and Conditions. In the event of any inconsistency, between the GoPayz Service Agreement and these Terms and Conditions the GoPayz Service Agreement will apply to the extent of such inconsistency.
f. The Programme and these Terms and Conditions are governed by the laws of Malaysia. The participants agree that the Courts of Malaysia have jurisdiction over all matters arising from the Programme.
